Dear All

Quite a number of Community Property Scheme owners & investors (i.e. body corporate) in South Africa are negatively impacted by the decisions made behind closed doors, between Trustees / Caretakers, Managing Agents and Community Schemes Ombud Service (CSOS).

CSOS is a government office which was established to develop and provide a dispute resolution service among the dwellers in these schemes; including contractors onsite, like Managing Agents etc. But CSOS is failing dismally in that department...instead they are playing bad politics with owners :

1. LACK OF TRANSPARENCY

1.1 Owners are even refused documents or records of their schemes (i.e. bank statements, debtors' analysis roll etc.), that are most times kept in managing agents' offices.

2. Managing Agents end up not servicing municipal day to day consumption (like sewer, electricity etc.), which end up putting these Community schemes in debt etc. Refer to cases like Motani Complex in Ridgeway, Castlerosse Body Corporate in Killarney etc. (Or https://www.saps.gov.za/newsroom/msspeechdetail.php?nid=2924, https://www.iol.co.za/personal-finance/keep-an-eye-on-your-body-corporate-1454704, https://www.privateproperty.co.za/advice/property/articles/sectional-title-make-your-managing-agent-pay/3159, bodies corporatebhttps://paddocksblog.com/2014/09/03/the-theft-of-f... etc.)

3. Municipality even putting historical debt on Community Schemes / Bodies Corporate's laps; subjecting the schemes to debts that do not belong to these etc.

Community Property Scheme Owners are expected to take up these kind of disputes to CSOS, at a certain fee! CSOS then drags these cases for months, if not years...Only to issue adjudication orders that mostly do not even make sense & in most times are always in favor of the managing agent💰 (Refer to KnowYourSyndicates.com as he exposes CSOS / https://knowyoursyndicates.com/tag/csos/). Then CSOS tells you to appeal their judgement with High Court; that's more money and another time to waste, as mostly High Court judgements side with CSOS adjudication orders SMH!

Even if an owner may decide to jump CSOS and take the dispute directly with Courts, that owner's application may be dismissed and be referred back to CSOS...only for CSOS to F up :(

Now it is time to engage CSOS, prior to forming class action as owners and take CSOS out!

Therefore I am organizing a peaceful march to CSOS (Centurion offices) in the month of October 2021. Dates and times TBA shortly (once there’s atleast some funds for the cause).


Most of all I humbly ask that you pray for me, as I'll be handling these donations, that God may be with me to use all funds strictly for the cause and account for each penny in the end! As there is a need to bring awareness around what goes down with and in South African Community Property Schemes.
