Right To Family Life in the UK

Hello. We are a family in need of your help.

We arrived in the UK last July 2017. My husband Neale is British and so it was easy enough to obtain British passports for our children; allowing them to reside here in Scotland with no questions asked. With the girls enrolled and settled in the local Primary School, and our family enjoying the quiet village life in Scotland, we have decided to stay.

However, the UK Immigration policy makes it rather difficult for Non-EU citizens such as myself to stay here indefinitely (even though I am married to a British citizen). I hold a New Zealand passport and therefore am only eligible to stay as a tourist for 6 months. If I were to go down the standard route of applying for a Spouse Visa, I would have to leave the UK, go back to Australia and meet the Income threshold to be eligible.

We consulted an Immigration lawyer and have been advised to apply for residency under Article 8; thereby exercising my human right to a Private and Family life in the UK, allowing us to apply within the UK. We feel this route is our best option. It does require an application fee of £1,000 and medical cover of £500.

Time is of essence.
