Mark of Innocence

Update posted by Barnett Survivors Limited On Aug 24, 2021

The Crown Prosecution Service have unsurprisingly attempted to whitewash and deflect serious complaints made on Mark's behalf, first by using a person we were complaining about and then by a person linked to the British Transport Police.

We will now seek to address this cronyism in court, because quite patently, Mark's prosuection could not have proceeded without his arrest; an arrest that the British Transport Police have admitted should never have happened in their out of court settlement.

Update posted by Barnett Survivors Limited On Oct 30, 2020

We have been unable to make a new campaign update until now, exactly three years to the day since James Barnett, the director of Barnett Survivors Limited, met with detectives to begin a reinvestigation into Mark's case.

We are pleased to announce, that following protracted negotiations, the British Transport Police have now admitted culpability for their role in implicating an innocent man, and have settled out of court in what is apparently the largest settlement by the British Transport Police in over a decade, and perhaps ever. Mark's case was spoken about in those terms.

This completes Phase One of Mark's case; we now move to Phase Two, which concerns the CPS bringing this false matter to trial. Phase One took 4 years of battle, with many twists and turns, and it is worth mentioning at this stage that the OIC, officer in charge, of Mark's case, is not a police officer anymore and never can be again.

There is much that we have been unable to talk about until now, such as a prominent London barrister losing the case file and really poor legal advice from another London barrister who thought he knew better than Barnett Survivors Limited.

Due to the system essentially trying to make Mr. Pearson's matter go away, we have been forced to break that impasse by escalating it and for legal reasons we cannot describe how or when or what; suffice to say it is a mistake to underestimate us or our resolve in this matter, and in due course we will be able to reveal what is happening in Mr. Pearson's case. Thank you.

Update posted by Barnett Survivors Limited On Oct 05, 2018

Sadly we have been forced to make a second IOPC appeal and complaint in Mr. Pearson's case, which is unfortunate given the progress already made historically and the understanding we had with certain officers. However, negotiations were not proceeding in a satisfactory manner, so we step away from those for the time being, and if the idea of 'negotiation' is still applicable after the second IOPC judgement in this case, will return to them in due course. More updates to follow.

Following the delivery of the reinvestigative report (that this company partially drove and oversaw), the police now admit misconduct and wish to make Mr Pearson a financial compensation offer, without prejudice. Barnett Survivors Limited has made a counter offer in the best interests of its client, Mr Pearson, ahead of possible negotiations.

Update posted by Barnett Survivors Limited On Jul 22, 2018

Have recently received notification from detectives working Mark's reinvestigation that they are due to deliver their findings within the next few weeks. From the very outset, Barnett Survivors Limited has pushed for criminal charges against anyone who or anything that has broken the law.

Update posted by Barnett Survivors Limited On Nov 11, 2017

Founder and Director of Barnett Survivors Limited, James Barnett, met with senior detectives and investigators at a police station in London on 31st October 2017, to discuss the reinvestigation into Mark Pearson's case. The officers requested Mr Barnett's entire case file on Mr Pearson, for duplication, and the reinvestigation / complaint proceeds on slightly more allegations than before as a result. It was a largely positive meeting and the officers from outside of the south of England seemed to grasp the severity of what was alleged, and recognised an IPCC complaint alleging perverting the course of justice had been upheld. In terms of CPS collusion into this case, it will be the Attorney General to investigate that, but these detectives can look into relevant aspects of CPS conduct without having the power themselves to do anything about it.

At this stage, it is impossible to offer any sort of timeframe for the conclusion of this reinvestigation as there is a huge amount of evidence to assess and investigate, but updates will be posted as and when they come in.

Update posted by Barnett Survivors Limited On Oct 24, 2017

Founder and Director of Barnett Survivors Limited, James Barnett, is due to meet with police in London on Halloween, the 31st October, to tell them what to do when it comes to reinvestigating the attempted miscarriage of justice against Mark, especially the evidence against the CPS, who are essentially in lockdown regarding this case and for good reason...

Update posted by Barnett Survivors Limited On Oct 08, 2017

Founder and director of Barnett Survivors Limited James Barnett will be meeting with two detectives to brief them and to steer the reinvestigation into the debacle around Mark's case, and the attempted miscarriage of justice at the heart of it. Will be motivating them in particular to look into a shady CPS meeting around the doctored CCTV evidence before Mark's trial. More to follow soon.

Update posted by Barnett Survivors Limited On Sep 06, 2017

It has been asked why this campaign is not directed solely at the woman who made the false accusation against Mark.

The first thing to say is she *will* be dealt with in due course.

She is just one perpetrator, however, and if the campaign only focussed on her, this will not actually change anything and what happened to Mark could happen to another man courtesy of another female perpetrator.

We are attempting to change how the police and CPS consider allegations of rape and serious sexual assault, to move them away from guilty until proven innocent when a man is accused by a woman, and to definitively establish perverting the course of justice on the CPS side (there is partial and significant evidence for this presently).

So once the CPS are dealt with, we will be moving onto Mark's accuser.

Wish I could give more. Been through similar things and been on the other side (actual attack and abuse) but the CPS refused to prosecute. (KE2001) There is something seriously wrong.

My 80 yr old dad went through a crown court case based on a ridiculous case that any half-wit (Police/CPS) could / should have investigated easily and seen there was no case to answer. Historic sexual abuse claim over 40 yrs old which the jury quickly delivered a unanimous not guilty verdict. The Police & CPS need to be held to account. Good luck with your case mark.

CPS fail to progress violence and robbery cases - in my own case - even though there is overwhelming evidence in the same way as false accusers are hidden in plain sight. Disgusting. Must be held to account and the heads must roll.
