Fair Access to his Son

URGENT HELP NEEDED IMMEDIATELY!

I am "Mark's" father.

Desperate for legal access to his son who has been taken overseas by his estranged wife.

This is a brief overview of the situation:

- Mark’s wife coerced & manipulated him into moving to Australia to set up life with his wife and 5 year old son. He entered Australia on a tourist visa as he is a South African Citizen.
- Marks wife had secured employment and could reside in Australia due to her also having New Zealand citizenship.
- His longer term stay in Australia was based on securing a spousal visa with the support of his wife which she promised.
- As he was not permitted to work and earn an income, his wife promised to support his son and him with her salary.
- A week after arriving at their destination, his wife requested a separation and this caused his spousal visa application to be denied, despite his wife falling pregnant (and miscarrying) and his mother in law offering to be a surrogate for another child.
- His wife then blocked his access to the Australian Bank Account which contained all the money to set up their lives in Australia, while his father in law distracted him by taking him out to lunch.
- Her next action was to cancel the return air flights to South Africa for herself and his son, thus clearly indicating her intention to remain in Australia knowing Mark would be forced to leave.
- Mark was then instructed to leave the home of his wife’s parents (where they were staying during their settling process) and find his own accommodation.
- His estranged wife forcibly removed his son from him (physically from his arms) and did not allow him access for up to 10 days in Perth, WA, not even a phone call.
- All attempts at counseling and mediation failed.
- With no financial support and a time limited tourist visa, he had no option but to return to South Africa without his son as his estranged wife had made it clear she was remaining in Australia despite all three having South African citizenship.
- His only remaining option was to make an application for the return of his son to South Africa, using The Hague Convention of the Civil Aspects of International Child Abduction. After more than a year this resulted in a court case. It then took the Western Australian judge 8 weeks to deliberate on the evidence and deliver a decision which unfortunately was not in his favor. - This decision was delivered without reason and he is yet to receive any reasons in support of the judges decision.
- His wife lied under oath in this court case and no action or accountability has been taken.
- Legal assistance provided to me by the relevant authorities has been described as "unethical" and I have engaged countless lawyers at huge personal cost in which actions such as defamation and giving false testimony have not been addressed.

- He is currently and for the last 15 months limited by his wife to two 30 minute calls with his son each week and she controls every aspect of his access and has told lies to people testifying on her behalf and to the 5 year old child.

His sole desire is to secure fair and legally supported access to his son through holding his estranged wife accountable to her actions in a court of law. For this to happen he unfortunately has to engage in legal processes necessary to get FAIR court orders in place.

Having been unemployed for 7 months, and exhausting funds he had on legal fees, he has no alternative but to plead for assistance in getting reasonable access to his son through legal process.

He just wants to be able to have fair access to his son and be a present dad through a court of law as his estranged wife is not granting him fair access. Please help!
