"CHRISTINA'S CASE"


Het foto- en tekstboek met de werktitel "The Verdict" / "Het oordeel" staat gepland voor najaar 2021 (enigszins vertraagd door de corona-pandemie). Het is een vorm van samenwerking van Banning en Boyer. Christina is zowel onderwerp als co-auteur en ze zal een actieve stem hebben in hoe haar zaak aan de wereld zal worden gepresenteerd. Het zal wereldwijd verspreid worden door Schilt Publishing.
Vanaf ergens tussen januari en maart 2022 zal de tentoonstelling 4-5 maanden lang te zien zijn in het Nederlands Fotomuseum in Rotterdam.

Hopelijk draagt het boek (en de bijbehorende tentoonstelling) ook bij aan het vrij komen van Christina: als iemand door de media kan worden berecht ('trial by media), waarom dan niet proberen dat om te draaien en haar onschuldig verklaard te krijgen door inzet van kunst en media?
Tegelijk pogen we ook langs andere sporen haar vrijlating dichterbij te brengen; één mogelijkheid - maar een die helaas tot nu toe zonder resultaat is gebleven - is een goed opgezette parole-campagne. Een andere optie die we onderzoeken is die van heropening van haar zaak.

Al 28 jaar onschuldig vast voor "moord" op haar dochtertje
Christina Boyer heeft bijna haar hele volwassen leven doorgebracht in een gevangenis in Georgia. Ze werd zo'n 28 jaar geleden gearresteerd, op 22-jarige leeftijd, en veroordeeld voor de moord op haar driejarige dochtertje Amber.
Op de fatale 14de april 1992 ging ze rond het middaguur naar haar werk. Amber liet ze achter onder de hoede van haar vriendje David. Toen ze zes uur later terugkwam, wachtte David in paniek op haar: Amber lag in bed, bewusteloos en ademde niet meer. In het ziekenhuis aangekomen bleek Amber overleden.




Schuldigverklaring

Het autopsieverslag gaf als doodsoorzaak op: hersentrauma en verwondingen aan de pancreas (alvleesklier). Dat leidde tot aanklachten wegens moord. Christina bracht de volgende twee en een half jaar in de gevangenis door. Haar door de rechtbank aangewezen pro-bono-advocaat bezocht haar slechts drie keer. Ze werd veroordeeld door de media en medegevangenen verscheurden haar foto's van Amber en spoelden de snippers door het toilet. Haar kans op een eerlijk juryproces leek miniem. Vlak voor het begin van de rechtszaak kwam haar advocaat met het verbijsterende bericht dat ze op de doodstraf moest rekenen en dat haar enige ontsnappingskans lag in een schuldbekentenis. Panisch vanwege de dreiging van executie en onder de invloed van een flinke dosis onnodige antipsychotica, stemde ze ermee in om een plea deal (een schikking) te accepteren. De rechter veroordeelde haar vervolgens tot levenslange gevangenisstraf voor moord, plus twintig jaar voor ernstige mishandeling (dodelijk letsel van de alvleesklier). Sindsdien kwijnt ze weg achter de tralies en vecht ze tegen zware depressies.


Nieuw bewijs
David's zaak kwam wél voor, nadat Christina’s zaak was afgesloten. Tijdens zijn proces kwam bewijsmateriaal aan het licht dat haar waarschijnlijk zou hebben vrijgepleit. Dezelfde arts die de autopsie van Amber had verricht, getuigde nu dat - in tegenstelling tot zijn oorspronkelijke rapport - de verwondingen aan Amber's pancreas helemaal niet dodelijk waren en waarschijnlijk vanzelf zouden zijn genezen. Hij verklaarde ook dat de gevolgen van de slagen op Amber’s hoofd zich vrijwel meteen zouden hebben gemanifesteerd. David verklaarde dat Amber zich in de eerste uren na Christina’s vertrek normaal had gedragen: dat impliceerde dat de dodelijke slagen wel moesten zijn toegediend tijdens Christina ‘s afwezigheid.
Analyses van de door Banning geraadpleegde Nederlandse specialisten, patholoog-anatoom Frank van de Goot en neurochirurg Guus Beute, leidden tot dezelfde conclusie.

David werd veroordeeld tot 20 jaar voor zware kindermishandeling. Hij kwam vrij in 2011.

Plea deal (schikking)
95% van alle Amerikaanse strafzaken komt nooit voor een juryrechtbank, maar eindigt in een plea deal, een schikking. Christina accepteerde een bijzondere vorm daarvan, een zogenaamde Alford Plea, waarin de verdachte haar onschuld volhoudt, maar de straf aanvaardt. Maar wat ze zich pas achteraf realiseerde was, dat dit evengoed wordt beschouwd als een schuldigverklaring. Daardoor is het vrijwel onmogelijk om haar zaak te heropenen. Haar nagenoeg enige kans om vrij te komen, is als ze parole (voorwaardelijke vrijlating) zou krijgen.


Vechten voor haar vrijlating
Al jaren werkt een klein groepje toegewijde aanhangers om Christina uit de gevangenis te krijgen. Kunstenaar / fotograaf Jan Banning uit Nederland is een van hen.

Enkele resultaten die we hebben bereikt in 2018-2019: universiteitsstudenten van een Making a Exoneree klas ontdekten dat beschuldigingen van kindermishandeling tegen Christina in Ohio, waar ze tot kort voor haar arrestatie woonde, allemaal als niet onderbouwd door de kinderbescherming waren afgewezen. De Nederlandse radiojournalist Katinka Baehr heeft een prachtige podcast gemaakt met de naam "Jan & Christina", die binnen 24 uur na de lancering op nummer 1 van de populairste podcasts stond. Journalist Lauren Markham schreef een fraai artikel over Christina en haar steunpilaren in Atavist.

Banning is geïnterviewd op Nederlandse en Belgische tv en radio (bijvoorbeeld hier, 7'25 "tot 17'30" en hier, 17'28 "" tot 26'50 ") en heeft lezingen gegeven aan universiteiten en kunstinstellingen in Georgië. Lokale media hebben interviews gepubliceerd en het fotofestival Atlanta Celebrates Photography is van plan een tentoonstelling van het werk van Jan Banning met teksten van Christina in Atlanta te organiseren.

Dankzij spontane donaties en een (eerdere) GoGet Funding crowdfunding-campagne konden we in november 2018 een gespecialiseerde advocaat inhuren. Helaas heeft dit er niet toe geleid dat Christina is vrijgelaten; het verzoek om voorwaardelijke invrijheidsstelling werd in december 2019 opnieuw geweigerd. De reden: "Onvoldoende tijd in de gevangenis gegeven de aard en omstandigheden van uw misdrijf."



Boek en tentoonstelling

Samen werken Banning en Boyer (van achter de tralies) nu aan een prachtig gedrukt boek (en een tentoonstelling), dat vermoedelijk in het voorjaar van 2021 zal worden gepubliceerd. Het illustreert hoe het Amerikaanse strafrecht, vooral waar het gaat om lagere sociale klassen, veelal faalt. Het werk geeft ook een voorbeeld van de impact die het langdurig gevangen zitten op een individu hebben. Achterliggende vraag is of het mogelijk is voor één persoon - in dit geval een van Europa's prominente fotografen - om een gerechtelijke dwaling recht te zetten, vooral in deze tijden van nepnieuws en rechts populisme. Het boek streeft ernaar om een voorbeeld te zijn van hoe kunst en activisme hand in hand kunnen gaan zonder de kwaliteit van een van beide in gevaar te brengen.

We - Schilt Publishing and I - plan to launch the book with the working title "The Verdict" in the autumn of 2021 (slightly delayed by the pandemic). It is one aspect of Banning’s and Boyer’s collaboration. Christina will be actively participating, she is both subject and co-author and will have an active voice in how her case will be presented to the world.
The exhibition will first be shown in the Netherlands and open in early 2022 in the Netherlands' Photo Museum (NFM) in Rotterdam. We are still looking for venues in the US and other countries.

Hopefully, the book (and the accompanying exhibition) will contribute to Christina's release from prison: if a person can be tried by media, why not try to turn it around and get her exonerated by art and media?
But we are also working along other lines, such as a continuing parole campaign; and we are investigating the possibility of reopening her case (Habeas at federal level).

Christina Boyer and Amber's Death
Christina Boyer has spent almost her entire adult life in a Georgia prison. She was arrested some 28 years ago, at the age of 22, accused of murdering her three-year-old daughter, Amber.
On that fatal day, April 14, 1992, she went to work around noon, leaving Amber in the care of her boyfriend David. When she returned, six hours later, David was waiting for her in a panic: Amber was lying in bed, unconscious and no longer breathing. By the time they arrived at the hospital, it turned out that Amber had passed away.


Coerced into pleading guilty

The autopsy report determined the cause of death as ‘blunt force trauma to the head and the abdomen' (in particular the pancreas). Both Christina and David were charged with murder. Christina spent the next two-and-a-half years in jail on remand, meeting her court-appointed pro-bono lawyer only three times. She was convicted by media and fellow prisoners tore up her photos of Amber and flushed the pieces down the toilet. Her chances of getting a fair jury trial seemed slim. Shortly before the start of her trial, her lawyer visited her and told her to expect the death sentence; he advised her that her only chance of survival was to accept a plea bargain. Devastated by the threat of execution and under the influence of a hefty dose of (unnecessary) antipsychotics, she agreed.
The judge sentenced her to life imprisonment for murder, plus twenty years for ‘aggravated battery’ causing a lethal pancreatic injury. Since then, she has been withering away behind bars, fighting depression.


New evidence

David’s case went to trial only after Christina’s case had been closed. But during his trial evidence was presented that could well have exonerated her. The same medical examiner who had handled Amber’s autopsy now testified that ‒contrary to his original report – the injuries to Amber’s pancreas were not deadly and would probably have healed without treatment. He also stated that the consequences of the blows to Amber’s head would have been manifest almost immediately. But David claimed that Amber had been fine for several hours after Christina’s departure, implying that any deadly blows could only have been dealt during Christina’s absence.
Analyses of Dutch specialists consulted by Banning, pathologist and anatomist Frank van de Goot and neurosurgeon Guus Beute, led to the same conclusion.

David was sentenced to 20 years for aggravated child abuse. He was released in 2011.

Plea Deal
95% of all US criminal cases never go to trial but are ‘resolved’ by a plea bargain. Christina took a so-called Alford Plea, in which the defendant maintains innocence but accepts the sentence. Unknown to her at the time, this is nevertheless considered a guilty plea, which makes it virtually impossible to reopen her case. Her only realistic chance of release is to be granted parole.


Support for Christina

For years a small group of committed supporters has been working to get Christina out of prison. Artist/photographer Jan Banning from the Netherlands is one of them.

Some results we have achieved in 2018-2019: University students of aMaking an Exoneree class have uncovered that the child abuse accusations against Christina in Ohio were all unsubstantiated. Dutch radio journalist Katinka Baehr made an amazing podcast called Jan & Christina (Dutch spoken) which got to #1 on the list of most popular podcasts within 24 hours after its launch). Journalist Lauren Markham wrote a beautiful article (long read) about Christina and her supporters in Atavist.

Banning has been interviewed on Dutch and Belgian tv and radio (e.g. here, 7’25” till 17’30” and here, 17’28’’ till 26’50’’) and has given lectures at universities and art institutes in Georgia. Local media have published interviews. And the community photography festival, Atlanta Celebrates Photography, plans to hold an exhibition of the work of Jan Banning (see photos and film) with texts by Christina, in Atlanta.

In November 2018, thanks to spontaneous donations and a GoGetFunding crowdfunding campaign, we have been able to hire a specialist post-conviction (parole) lawyer. Unfortunately, this has not lead to Christina being paroled yet; in December 2019, her parole request was denied once again. The reason: "Insufficient amount of time served to date given the nature and circumstances of your offence(s)."

Book and exhibition
Together, Banning and Boyer (from behind bars) are now working on a beautifully printed book (and an exhibition), to be published in Spring 2021. It will highlight how American justice, especially when applied to the poor, can and often does go wrong. The work also provides an example of the impact incarceration and the prison system in general can have on an individual. Next, the book explores whether it’s possible for one person – in this case one of Europe’s prominent photographers – to rectify a miscarriage of justice, especially in these times of fake news and conservative populism. In the process, the book will provide an example of how art and advocacy can go hand in hand without compromising the quality of either one.
