Today I am sad.... angry ... I feel let down by justice .... the last bit of hope I had in making sure that the person that raped my child and threatened her with death if she should ever tell, will notj get away with it, has been stolen away. Because of a broken system.....

Today, after a full year of trying to prepare my already broken child to be able to tell her story in court. after 3 postponements ... 6 days away from the start of the Trial, I received this email from the court.

Good Morning Sir/Madam

I have been considering the merits of this matter in terms of the prospects of success in the event that a trial would proceed. In the process I have considered the following;

  • The evidence in the docket;
  • The consultation of the prosecutor with the victim in this case;
  • The consultation of the Court Preparation Officer with the victim in this case;
  • The professional views of the Court Prosecutor and the Sexual Offences Case Manager and
  • The applicable law.

I have unfortunately come to a considered view that there are no prospects for a successful prosecution in this matter. The intended course of proceeding on the 19th March 2018 is that the matter will be withdrawn.

This is definitely NOT what the docket support ... we have an extensive Forensic Assessment Report done by an expert in the field of Sexual Forensic Assessments, as well as a J88 medical report that support Forceful penetration ... not to mention, that my daughter was deemed competent to testify in court only 3 weeks ago ...so what they are basing their findings on only they know.

THE ONLY THING THAT IS LEFT TO DO IS TO APPLY TO THE PRIVATE PROSECUTION AUTHORITY TO TAKE THE MATTER OVER AND FOR US TO PROSECUTE PRIVATELY ... BUT THIS IS GOING TO COST A SUBSTANTIAL AMOUNT OF MONEY.

I NEED YOUR HELP TO MAKE THIS HAPPEN. IS IT OK THAT CHILDREN WHO SUFFER OF A DISABILITY, WHO IS TOO FRAGILE TO TESTIFY, WHO MIGHT NOT BE ABLE TO STAND CROSS EXAMINATION TO BE RAPED AND FOR THEIR PERPETRATORS TO GO FREE.

THIS CANNOT BE ALLOWED .. PLEASE HELPS US RAISE THE NECESSARY FUNDS TO MAKE SURE THAT THIS INJUSTICE DOES NOT HAPPEN.

I am not a violent person ... but mob justice is becoming more and more appealing to me ... sigh ... I know, that is not the answer, but it is real difficult to accept the answer that was given
