My name is Emily Dougherty and I volunteer for various organizations in PA working towards ending mass incarceration. I met Isaac Pearson through my volunteer work and have since learned just how incredibly unjust his incarceration is. There have been recent developments that could get his case re-examined. We are asking those that can to please contribute what you can so that Isaac and his family can retain legal representation. 100% of contributions will go directly to Isaac and family.

Isaac has been wrongfully incarcerated since 2015 sentenced to 17-34 years for nonviolent crimes he did not commit in Allentown, PA. He was wrongfully charged with the following alleged crimes, where there was no violence, no assaults, no injury, no children, no weapon, and no drugs:

Count 1. Trafficking in Individuals - F2 3011(a)(1) 5 - 10 years]

Count 2. Trafficking in Individuals financial benefits - F2 3011(a)(2) 5 - 10 years]

Count 3. Promoting Prostitution - F3 5902(b)(3) 3½ - 7 years]

Count 4. Criminal use of Communication Facility - F3 7512(a) 3½ - 7 years]

As the record reflects, here are 3 key unlawful pieces of his trial:

  • The arrest was based on unsubstantiated hearsay
  • The trial judge knowingly allowed cell phone information obtained without a warrant. This was brought up in the pre-trial hearing on 12/17/2015, the judge acknowledged it verbally but still allowed it to be used as evidence.
  • The only Commonwealth witness used by the prosecution was unrelated to the arrest. Her arrest history was erased in exchange for her testimony. When Mr. Pearson brought up her arrest history challenging her credibility, his self-representation was terminated.
    This one and only Commonwealth witness, who had nothing to do with these charges or the case against him, had previously received ARD (Alternative Rehabilitative Dispositions) for access device fraud, retail theft and theft by deception. In exchange for her testimony, her arrest history was erased, and her nursing license reinstated. When Isaac tried to question her about her arrest history during trial, his self-representation was terminated. Denial of self-representation is an automatic reversal and under the fourteenth amendment, everyone has equal protection of the law!

On the day of Mr. Pearson's arrest, Detective Jason Krasley alleged that the $905 in his possession came from a lady who never made a Court appearance. Ultimately no nexus was made with the charges and the money. Isaac provided bank statements showing recent withdrawals and a college loan disbursement in the sum of $2,360.40. His currency was eventually returned by Judge James T. Anthony.

Additionally, Attorney Robert Long appealed to the Superior Court for Isaac’s sentence to be ran "together/concurrent" since there was one incident and one victim. They responded saying his appeal was "Underdeveloped". The Superior Court reviews illegal sentences "sua sponte" meaning “of one’s own accord, voluntarily” …Why hasn’t Isaac’s case been reviewed?

Today Isaac is still incarcerated at SCI-Somerset, currently serving his 8th year in prison. Before going to trial, Isaac was offered a plea deal by the prosecution for 2 years’ time served if he pleaded guilty, but he turned down the plea to defend his innocence. 17-34 years is egregiously excessive for a case where there’s lack of evidence, irrelevant witness testimony, and self-representation taken away. Somehow the court still found him guilty on all counts and was given the maximum sentence for each charge. He was not given a fair trial and had no defense. The story told to the public is different from what was said in the trial and what is published on Lexus Nexus.

Isaac is a father of 2 who has missed 8 years of their lives, he has become a published author and certified paralegal while incarcerated, he is a talented musician, and a human being who has been and continues to have his rights violated and freedom wrongfully taken away.
