Sunt gunoaiele toxice? Împreună aflăm dacă în Pata Rât se poate locui

În decembrie 2010 Primăria Cluj-Napoca a evacuat 76 de familii de romi de pe strada Coastei și le-a mutat în mod abuziv lângă groapa de gunoi de la Pata Rât, în locuinţe construite de Primărie. Nouă ani mai târziu, acești oameni locuiesc în continuare la câteva sute de metri de munți de gunoaie și lichide toxice. În 2015 rampa veche s-a închis, dar nu este ecologizată nici azi. Tot atunci, autoritățile au deschis două rampe noi. În 2019 una dintre ele s-a extins la cinci platforme. Rampa de deșeuri industriale periculoase din zonă are autorizație valabilă până în 2022. Aceasta este o dovadă clară de rasism de mediu. Autoritățile clujene au trimis persoanele de etnie romă să locuiască la periferia societății, printre deșeuri, acolo unde nu există nici școli nici spitale, acolo unde aceste persoane nu pot fi văzute și auzite.

Dar romii nu sunt gunoaie! Refuzăm să acceptăm umilințele și tratamentul injust al statului. Locul nostru nu e la periferie, și vrem să ne facem auzite vocile. În toiul dezastrului ecologic, vrem să spunem tuturor că noi suntem printre primii oameni afectați. Criza deșeurilor, toxicitatea aerului, a apei și a solului – toate acestea ne lovesc întâi pe noi, cei și cele de la margine.

În fața acestor lovituri am decis să rezistăm și să ne cerem dreptate la curtea de justiție. Suntem 50 de persoane din Pata Rât și, laolaltă cu Fundația Desire, am acționat în judecată Consiliul Local și Municipiul Cluj-Napoca prin Primar, Consiliul Județean Cluj, Județul Cluj prin Președintele Consiliului Județean, Regia Autonomă a Domeniului Public Cluj-Napoca și S.C. Salprest Rampa S.A. Cerem închiderea și ecologizarea rampelor de gunoi, precum și plata unor despăgubiri.

Însă nici curtea de justiție nu e pentru cei marginali. Pe lângă cheltuielile de judecată, suntem nevoiți să plătim o sumă enormă pentru onorariul unui expert de mediu, care ar trebui să decidă dacă rampele de gunoi sunt într-adevăr un mediu toxic pentru cei și cele ce locuiesc acolo.

Așadar, am decis să apelăm la solidaritatea voastră pentru a duce la bun sfârșit acest act de rezistență. Vrem să facem autoritățile responsabile pentru situația înjositoare în care ne-au pus. Avem nevoie de donații pentru a ne sprijini eforturile în sala de judecată.

In December 2010, the Municipality of Cluj-Napoca evicted a total of 76 Roma families from the downtown and forcefully displaced them next to the city’s landfill in a place called Pata Rât. Here, the Municipality offered these people a number of dwellings built for them closer than the range of minimum 1km from the landfill that the law prescribes. In 2015, this landfill was closed and two other new ones took its place. The old landfill has never been fully sanitised. Currently there are five new landfills in the Pata Rât area, including one that contains dangerous industrial waste. This is clear evidence of environmental racism. The Cluj authorities displaced Roma people to the periphery, among waste and garbage, where there are no schools or hospitals, where these people are not to be heard or seen.

But the Roma people are not garbage! We refuse to accept the humiliations and the unjust treatment of the state. We do not belong at the margins, and we will make our voices heard. Amidst the current impending ecological disaster, we want to make it clear that we are amongst the first to be hit by it. The waste crisis, the toxicity of the air, the water and the land – all of these are felt harder at the margins.

Confronted with this situation, we decided to resist and demand our rights in the court of law. We are 50 people from Pata Rât, and together with the Desire Foundation of Cluj Napoca, we sued the local authorities. We demand the closure and the sanitation of the landfills, and we also ask for financial compensations.

However, even the court of law turns its back on those at the margins. Along with the trial expenses, we are required to pay a considerable fee to a so-called environmental expert that will scientifically and objectively decide whether the landfills are indeed a toxic environment for the people living there. This is a requirement of the judge.

Therefore, we decided to turn to your solidarity in order to fulfill this act of resistance. We will make the authorities responsible for the degrading situation in which they are trying to put us in.
