  1. This page will be updated shortly. Have 30,000 plus Speeding Tickets been issued unlawfully under the ACPO Code of Practice Section 7.1 sec 7.4 sec10..1 and sec 14.4

I am appealing a speeding conviction 35 in a 30 zone at Winchester Crown Court on March 12 2020 before the most Senior Judge sitting in Winchester, HHJ Cutler, colloquially known as the "smiling assasin". Obviously I am adamant that my speed was within the limit and have advanced several ways the Officer managed to exaggerate my speed.My aim is to insure that the Police follow basic rules set out in codes and guidelines that are needed to uphold a legal conviction. It appears that many Police forces believe these rules are unnecessary and therefore disregarded.

The Officer had been Targeting over crest of Northam Bridge, maybe hitting windscreen, bonnet, headlight,white lines on road or LARGE metal POST seen in camera scope directly in line of sight before registration plate. Deflected returned pulses from bollards , cars between target and laser or on other side of road. Targeting over multiple cars hitting roofs.
  4. However I have been unable to examine any evidence that the Police followed any basic requirements needed to ensure the laser, scope and camera were checked and tested as set out in the Laser manual, ACPO code of Practice or the more recent NPCC guide, which are needed to uphold the conviction.
  5. Despite numerous requests to the 3 Courts, Aldershot, Basingstoke and Winchester, the Police and the CPS. I have been unable to gain any disclosure of documents including the video recorded as the original evidence.
  6. MOST IMPORTANTLY I have questioned the legal status of the designated location in the central reservation of the Dual Carriageway on Northam Bridge A 3024 Southampton under Section 7.1 Section 7.4 and Section 10.1 of the " ¡ACPO Code of Practice for road ENFORCEMENT and the legal interpretation of "MUST NOT be used for ENFORCEMENT PURPOSES in the central reservation of a Dual Carriageway" contained within Section 7.4.
  • District Judge Tim Pattinson presiding over the trial at Basingstoke acknowledged the illegal aspects of the capture on three occasions during the trial but still passed a guilty verdict, upholding the conviction.
  1. Hampshire Police, the CPS and the Courts have been unable to provide an explanation of how the capture was lawful and within any of the codes of practice, guidelines or laser manual requirements for over FOUR MONTHS. The designated location has been regularly targeted since at least 2006. Thousands of speeding tickets may have been issued illegally.
  2. I hope to gain a definitive list of the tests and checks required, confirmation of the legal right to see video evidence and the minimum disclosure.expected to be provided to a defendant by the Police and the CPS when pleading Not Guilty to a speeding offence.
  3. I believe I may be unsuccessful in my appeal before Judge Cutler sitting alone, as he has also failed to order disclosure at this time and has commented that "NO, the appeal must be dealt with in Winchester" and so I will have to appeal to the higher court to gain justice. As I am a builder by trade any help with the costs involved would be gratefully received and as I have a Law degree any money left would be used to help others trying to seek justice if wrongfully captured. If anyone is near Winchester on the 12th of March and wishes to see justice in action, the appeal is set for 10-30.
