OVERVIEW 

Our future was stolen from us this week.

Marsha’s ex-spouse was granted permission to take our boys, and move with them to Washington D.C., a place they have no friends and no family.  We’ve spent the past 18 months in court trying to prevent this from happening, were successful with a previous attempt, and tragically the unthinkable happened.  What this means is our time with them has been halved – our kids are doomed to airports and hotels and leaving the life they love.

Since we received the ruling from 6/3/2013, we have worked closely with our trial attorney to learn what our options could be. We can try to appeal the ruling or we can sit back and let it happen. After speaking with several other Judges, other attorneys, and psychologists, we believe based on the main reasons necessary we have a case for appeal.   However, this will cost upwards of $30,000 for a chance to try to stay the decision and to overturn the judgment. And sadly, most appeals are a long-shots, and have to have strong evidence and a kick-butt appeals attorney behind them to even have a chance.  The clock is ticking - there are a mere 10 days to file for post-judgment orders, and 30 days to file for an appeal of the decision from the higher court.   Once the boys leave, after 6 months, the Commonwealth loses jurisdiction over our case.  She is already trying to take them out of their current school before the school year ends to start the clock.  WE CAN'T LET THAT HAPPEN. 

So why we are sending this to you today is simple. After spending an incredible amount of money and savings to fight the battles we have already waged, we need to acquire the means to retain an appeals attorney soon.   We then have to make the hard decision of if we pursue this uphill battle of an appeal. So this is where you come in. ..this is not something we take lightly, and obviously we feel our lives, our children’s lives and our future is on the line.   We know this is so much to ask. And we never have done anything like this before in our lives.  We have done serious soul searching to make sure this is not just "sour grapes," and can say with a clear consious that the wrong decision was made, confirmed after talking with impartial counsel.  

So we ask for your help. Help us to start the process to see if we have a chance.   Here’s our promise:  if after extensive review, we feel we cannot succeed, we will return your donation to you minus only the overhead from the fundraising.  We will make that decision on Independence Day.    Those of you who know us are likely suprised at this web effort, but when it come to YOUR OWN KIDS, sometimes you have to do things that are not comfortable or easy because it is what you have to do.
