There is and emergency need for funds to relocate a senior citizen and cats , who is being evicted from current dwelling after 13 yrs good tenancy by a landlord who is an uncaring. This is not an issue of unpaid rent or property damage by the tenant.
WHAT Happened just
The issue is over damages the landlord himself caused and is morally and financially responsible for. He hired unlicensed, uninsured tree trimmers, who cut down a tree, dropping limbs on the power line to the house. This caused a break in the power line ground, causing huge power surges through out the house. The surging power blew every light blub, ruined every lamp, burned out surge bars, and burned out refrigerator components and a transformer in the furnace. The circuit breaker panel never engaged, allowing unregulated power to surge into the house.
The landlord was notified of the limbs coming down on the line. He did not call the power company as is required. He was notified of the power surging, again he did nothing for 5 days. Finally after being notified several times, he contacted Oncor the power provider. Oncor immediately sent a repairman within the hour to fix the line. At this point the house had been without useable electric power for 5 days. No heat, no lights and many damaged items. The landlord took another 2 days to get a qualified repairman to fix the furnace. First he shows up with some unlicensed guy to fix it. This guy claims it's some big expensive repair part that has to be ordered. Then a few hours later the licenced repairman that installed the unit shows up, in 10 minutes the furnace is fixed, says it was a transformer that burnt out. When that landlord was asked to replace the most important of the damaged items, he insisted that Oncor would pay for damages, insisting the tenant call Oncor. The call was made, the Oncor regional manager spoken to. Manager says Oncor is not responsible for the power surge, that the landlord was negligent in not calling Oncor before trimming to shut the line down for a few minutes during the trimming of overhanging limbs. Oncor said all licensed trimmers know to do this. Oncor said the liability in this case is with the trimmers insurance and if they are not licensed & insured, then final responsibility lies with the landlord who hired unqualified people. Landlord was told all this and asked to reimburse replacement costs of the most important of the items damaged. First the lightbulbs and a couple of the melted surge bars. The refrigerator didn't become obvious until all the food turned up spoiled. Tenant told him there would be deductions from the rent in proceeding months and receipts sent to him. This was done for the last 3 months, small amounts under $100, there is still a balance of $255 left on replacement of the refrigerator with a fair used one ($280) . The things the landlord was asked to replace:
12 energy efficient lightbulbs that were blown.
3 surge bars
A magnifying work lamp
A heating pad
Landlord be was not asked to replace any of the other lamps or appliances, only the ones immediately necessary.
What the LANDLORD DID
At this point, the landlord stuck a typed sheet of paper on the kitchen door as notice to vacate by Feb 29.
A Few Facts
This senior has no running transportation and no income beyond a fixed income from social security , and the landlord knows this. The landlord is well aware of the fact that the tenant is disabled and living on social security. He knows he has been paid rent that is more then half that income for the entire tenancy. This is not the first time this landlord has created a financial liability for this senior or left the house without heat or functioning plumbing, doesn't do maintenance only crisis repairs with long delays first.
****Asked to fix an outdoor water faucet, then leaves the water run for 2 days running up a $400 bill with the city.
******The landlord runs power to his barn from tenant's meter. Never told about this at move in. It's illegal to do this. Landlord has no right to electric power from a tenant's account. Landlord had some people come repair his barn, running power tools and compressors for over 2 weeks, then comes to the door says " here's $20 that will cover any extra on your power bill.* Bill was a lot more then $20 higher but how can you prove it?
******Asked to fix the 50yr old furnace several times. Always several days delay. Notified that furnace was blowing fumes into house, bring unlicensed guy who claims it's a dirty filter and tenant's fault, 7 months later after tenant had to have the furnace evaluated it was condemned as faulty, finally replaced. Landlord was mad that tenant had a licensed professional look at the furnace .
*****Sewage backed up into tub and toilet. Landlord ran a snake, didn't fix the problem. Left tenant with backed up sewage for 3weeks before finally having a local backhoe guy replace the line out to the street. No more backups in over 10 years since. Landlord's excuse for delay, backhoe wasn't available. Tenant didn't have use of bathroom for 24 days. Did landlord offer any compensation? Of course not.
*******Asked for screen door and window screen repairs due to age and BB gun holes from previous tenant, ignored .
******Landlord told about roof shingles coming down several times, ignored until a wind storm finally took dozens off front of house and could be seen from the street . There is water damage in some exterior walls from this and further compounded by termite damage to the house frame.
*****Landlord asked to fix front door so it would stay closed, ignored. Tenant has had to barricade the front door so it doesn't blow open.
*****There are serious foundation issues ongoing which the landlord refuses the recognize or repair. Several places the brick is split or missing exposing wood frame. Slab is not stable as landlord claims, floors are no flat, walls are cracking at seams in drywall, nails are pulling loose in many places more then a half inch above drywall. The enclosed carport floods, then drains thru the outside wall, same in the furnace room a/c drain backs up and floods draining thru walls to outside and into laundry room. The whole house leans to the down hill side enough to cause the cement foundation to spaul at one corner. None of these issues are being addressed by this landlord.
******This is just an example of how the landlord operates. He owns 9 or more houses in similar condition, all rented to people he knows don't have any other options . He knows moving for them would be a huge crisis. His answer to an complaint is always,* if you don't like it then move*.
WHAT IS NEEDED?
A different house in decent repair to rent.
Repair or replace 25 yr old Suzuki Sidekick . Needs exhaust manifold, catilitic convertor, A/C compressor, possibly other repairs.

$ to pay new car insurance
$ to pay moving help and truck
$ to pay deposits on rental and utilities.
Necessary dental work
Something to put in a small emergency fund

What I am asking is your help in creating a better situation for this senior. There is more needed then just a different house. A running and dependable car is a necessity too in rural Texas to shop and get to medical appointments, nothing is walking distance here. No sidewalks either. There is the need for help moving, packing, loading a uhaul, unloading etc.
Due to the limited finances over the last 15 years or so, there are personal issues that need to be addressed, such as dental work that has been deferred for lack of funds and insurance. You can't eat well without teeth in decent shape. Broken and missing teeth need replacing and it seems that in rural Texas there's no competition in dentistry, prices are high and there are few providers. Even the ones that are here require travel to get to.
I would hope to build a little cushion beyond just finding a new place to live, as it seems that move is going to require a higher rent, meaning even less money each month for utilities, food and other necessities. A little bit set aside in case an emergency happens.
This senior has not been wasting money. There is no cable TV bills, no internet bills, no computer either. No going out to eat or anything else for a long time. The only connection is a cheap pay as you go phone, not an iPhone or anything close.
