Raymond Hughes was hit by a drunk driver and the victim of a motor vehicle accident, but victimized twice over by the harsh anti-gun laws of New Jersey. Raymond is a Pennsylvanian resident, permitted to carry in his home state, traveling through New Jersey, when being the victim of another’s crime resulted in him being charged by the State. Raymond is presently charged with the second-degree crime, N.J.S. 2C:39-5B, “Unlawful possession of a weapon” which carries with it the presumption of New Jersey State Prison time, with sentences ranging between 5 and 10 years with a mandatory period of parole ineligibility of between 3 and 5 years. Under the Graves Act, the judge must follow this mandatory sentencing provisions if Raymond is convicted.
