Legal Fund To Remove Stephanie From Foster Care

Update posted by Tina Shake On Oct 25, 2014

Thank you for all the supporters on this site.  It has been amazing the out-pouring of love, prayers and funds to help Stephanie's family get an Indiana lawyer to go through the maze of laws.

September 3rd, FINALLY Stephanie was able to go to her Father's and Stepmothers home.  She is doing well and safe.  It isn't the end of her terrible experience by a long shot.  First of all.. Stephanie is home through an inter-state pact, she is still a ward of the court.  Her father is technically her Foster Father at this time.  There are many miles that he must still travel for her counseling and getting her ready..

The state of Illinois is requiring her to face her stepfather in court.  She will not be allowed to testify in the judges chambers.  The reason behind this heart breaking decision is that the state wants to put this man away for 30 years so he can not victimize another girl (this isn't his first time).  There is medical evidense of Stephanies injuries in the attack.. but her stepfather was NOT the only man in the home, so they need her to testify that to specifically what he did (to make it a felony for her specific injuries) and that it was indeed him.  We are devastated for her.  However we are taking the stance of empowerment.

Stephanies family is making multiple trips to Illinois to get used to the court room, meet the prosecutor and go through her instructions and interview.  She is also in counseling of course, they are working very hard to get her through this with the least amount of trauma.

The INDIANA courtcase was delayed as the judge had a family emergency the day of the trial.  The family is awaiting a new court date... we need this full custody in place by the State of Indiana!

The mother, well she has supervised visitation and has not visited her daughter since April.

Levi continues to need support.  He and his wife work in a medical factory and have a modest income.  He has been selling personal belongings, canceled cable and conserving money any way he can.

I don't know how much more they can take.

Here is it August 2014 and Stephanie is still in Foster Care.  Thankfully Levi and Emily are allowed to spend the weekends with Stephanie as long as they stay in the state of Illinois.  Levi and Emily both work full time at a medical factory in Indiana.  Early Saturday mornings they commute from Indiana to Illinois to pick up Stephanie from her Foster Home and go camping.  If the weather is too hot or rainy they must get a hotel for Saturday and Sunday.  Of course this mounts up in $$ but they are determined to spend every minute that they can with her.

Stephanie continues in therapry for her Post Traumatic Stress and to help her deal with this whole ordeal.  She is making progress!  She is getting much needed dental care, which let me tell you that was very difficult for her.  Daddy drove to Illinois for two dental visits and it went much smoother with many hugs.

Legal Progress:  The 2 1/2 interviews were done in Indiana to clear the way for Stephanie to live across state lines while the case continues on. In July the judge got to read the interviews and it was clear he was very disturbed at what he was reading.  The interviews put a clear prospective on Stephanie's life previously.

The home visit was completed however it has been over a month waiting for this to simply be typed up and submitted to the main Indiana Office and then onto the Springfield Illinois Office.  This is the ONLY thing standing in the way of Stephanie getting out of Foster Care.  Once she is out of Foster Care, she will still be a ward of the state until the case is completed in Illinois.

With the generous help of friends, family and donors from all over the US, Levi has a lawyer in Indiana for the custody.  That looks to be open and shut type of case but the closest court date is in October.  Ugh...

Expenses are certainly mounting up between lawyer bills, traveling expenses, hotels and time off work for medical appointments.  Why, why does an innocent parent have to suffer so financially not to mention emotionally?  The red tape is tremendous.  As the Grandmother of Stephanie I am flabbergasted that the mother isn't suffering the same even though she has been charged and convicted of Neglect.  Since she does not visit Steph, there is not any financial burdens of travel, hotels and time off work.  Oh well, we thank God for Stephanie, we thank God for such a wonderful Foster Mother and we thank YOU our backers.  Thank you for the prayers and thank you for your support.

I just saw the support from our old hometown of Raglesville. I have tears now. That was such an awesome place to raise your children. Our kids could play at night without worry. Everyone knew everyone, all the kids gathered in front yards, rode bikes, camped out. It was like Mayberry. Love you all!

Safety and security should always be at the forefront with kids. I hope this can be handled timely, for Stephanie's sake. Sending contentment and healing thoughts and wishes to all.
