Legal Fees, To be able to URGENTLY GET OUR 2 1/2 year old GRANDCHILD OUT OF FOSTER CARE

We have just heard back from our solicitor who says,

"I have spoken with the solicitor in the case. She hopes the Viability Assessment ( for us to be put forward by social services as guardians for Ellie) will be completed by the 8th December with the kinship assessment being completed by March 2018."

MARCH! Unbelievable.

So, of course we immediately responded, "that's a long time - How soon can we get to Ellie on a regular basis? Have they applied to the court yet to gain us access?"

Bridget has still not been allowed to see Ellie. Thank God we have friends in the city where Bridget can stay in the meantime.....

What more can I say...... March....... we wanted Ellie for Christmas....March! For the Kinship assessment to be completed and then how long before all the other proceedings are complete. Sigh.

In any event, we trust God and press on.

So......I asked our solicitor, "Is it right for the legal team and solicitor to to take so long to respond to a request from you, our solicitor?!"

Our solicitors response was enlightening.

"They are probably very busy and don't see us as a priority as you are not parties."

Of course I asked if "We should become party to proceedings right now then!"

She responded that "..Party status is not easy to achieve. It is only granted when one either has parental responsibility or one is a biological parent. In your case, at this stage you would not be granted party status, you are currently being assessed. If that assessment was negative and you disagreed with it then we would have to make that application along with an application for further assessment. If the Local Authority positively assess they will automatically undertake a friends and family assessment. So at this stage no need to take any further action."

Meanwhile as our son told us that he had asked and given his solicitor permission to speak to us, we contacted them. They replied saying: "Thank you for your email. I am afraid I cannot give you any advice and I explained this to your son. ...I am sorry that I cannot communicate with you any further and wish you all the best....Yours sincerely, etc. "

So, until and if they choose to communicate with our solicitor, we are in the dark, and machinery keep on turning.

Obviously to get Ellie, we shall have to show that we have a base of accommodation in the UK. So, we would appreciate your prayers as we look around and reach-out to folks. Just 'where' we look is the question. Again, prayers please.

I have driven down from Main back to Massachusetts today and am hold up in a Motel catching up on emails. I am slowly making my way back down to Atlanta Airport to join Bridget in the fight on December 2nd.

"I have just heard from our Solicitor "I have yet to hear back from the legal team. (Social services) In the meantime, I have dictated the client care letter to you and set out your instructions and my advice. -----I hope the letter will be typed tomorrow and be emailed out to you."

I replied asking if this tardy response was unusual and for the solicitor to give them a rocket!

My wife, Bridget feeling a bit down today. Another day without Ellie. And our Son, Ellie's Father..is not doing well at all.... Still, we press on.

Thank you for your prayers everyone, they are upholding us.

PS. Bridget has decided to stay and wait for me to come to her in Brighton. This is largely due to the generosity of a couple of friends who have given her a room free of charge to make it so. Bridget has my/our car, which we could not sell, so is getting around. I suppose this s good, as we in faith, will need it for Ellie.

So, Bridget had here first meeting and interview with Social Services today. She remains still confused. And we STILL have no date for contact with Ellie. Meanwhile, I received an email to say that social services had put back their meeting with me and then with both Bridget and me by a couple of days.

Frankly, I am concerned that we still cannot see Ellie, and they say that is because they need to get back to court for permission. In an email, I was told they had already done this? Now, I am confused.

Bridget also found out that Ellie's mom had also put her mum (Ellie's other grandmother) forward as a possible guardian. I am not worried by this. Still, being 4,000 miles away may be a factor in increasing my concerns that we get visibility all the information as soon as possible, and that we know all court dates and proceedings. I am a little frustrated for sure. Meanwhile, we passed a timeline of events as we know them on to our solicitor, who, by the way, STILL has had no response from the legal dept of Social Services despite two requests, and has now asked for the direct address of the solicitor acting on Social Services behalf. Meanwhile, our solicitor has counselled me not to be too anxious, and shall be hope to be able to dictating letters to me tonight and I hopes I will receive them by Friday.

No doubt the coming days may well get messy.

Still, we press on and appreciate all your support.

Got an email from one of Ellie's social work team today:

"As part of the initial viability assessment Charlotte and I are available to see you both on the following dates: Robert Farrell on 4/12/17 at 10 am ----Robert Farrell and Bridget on 5/12/17 at 12:00 - as part of the assessment we like to see people separately as well as together. We are inviting the Friends and Family Team to these meetings because if we recommend you for the full and longer assessment they will be undertaking this and it would be good to have their input in the process. Many thanks,.."

So two things are clear here:

1) I do not have to immediately have to return to the UK, but as soon as I get back to Scotland, I have to make my way down to the South coast of England.

2) This is our first mountain that we have to get through/over to proceed in getting Ellie May out of Social Services Foster care.

At the moment, I am sat in a MacDonalds in Maine. My AT & T cell has no ceoverage up here....joy!

Well, Bridget made contact with a very nice, professional and helpful solicitor who is now acting on our behalf.

Charges are £3.33 per minute plus 20% Value Added Tax. with £500.00 to be held on account.

Bridget was with our solicitor for 80 minutes, first thirty minutes free, that's £200 inc. VAT.. for now... I think, Thank you guys for making this possible. Now then, lets see where we go.

While Bridget sat before our Solicitor, I was on speakerphone on her cell. Technology is a wonderful thing.

Like I say, our solicitor appears to advise on all aspects of family law and had thoroughly advised us!

1) She will be contacting the Social Services legal team today to find out the lay of the land and instruct them that she is acting on our behalf, to be guided through the Viability Assessment

2) She is also going to find out if I have to return to the UK early, that is before December 02nd,

3) It looks as though Social Services are going to do a Viability Assessment on me and Bridget

4) IF..I say,,IF...this is positive, then they will then do a Kinship assessment. i understand this is like having a masochistic proctologist let loose upon you with no anesthetic!

NOW THEN SHOULD WE PASS BOTH THESE ASSESSMENTS- (WHICH I UNDERSTAND COULD TAKE 12 PLUS WEEKS OR MORE) then Social Services will put us forward as Legal Guardians.

So, at this stage (it could change and well might) we do not need to be party to legal proceedings...I think.

So, I am waiting to find out today, (hopefully) If i have to return to the UK early..Meanwhile...tomorrow at 6:00am I am supposed to be heading for the State of Maine......watch this space!

If we do eventually (don't knew when yet) get to see Ellie, then their is no way we can live in Scotland and travel a thousand miles a week round trip to see Ellie for an hour. So....pray with us as we decide what we need to do here. I am sure that this is one of quite a number of mountains we have to remove.

This is an OLD picture of Baby Ellie....look at that smile!

I read the other day, that in the UK, that 33,000 children a year are taken into care in the UK! That's 90 children per day. Shocking.

Well yesterday was an interesting day. I must say, that thus far, Social services have treated us with the utmost courtesy. Even so, it was an email I sent to the head of social services that a got a response to us regarding Ellie's situation.

"As Ellie is on an interim care order, the court has to agree to any care plan and contact arrangements for Ellie. As a Local Authority we are only able to implement care plans which have been agreed by the court. We have made an application to the court for you as grandparents to have contact with Ellie, and are awaiting their decision. To manage expectations, this would be likely to be not more than once a week. We have set a timetable for a viability assessment, the first appointment being on 14/11/17. If the outcome of this assessment is positive, we will refer for a full family and friends assessment which would take 12 weeks. The legal process and assessment processes have a specific framework and timetable which we are not able to supersede.I advise you to continue to liaise with your solicitor to take legal advice on this matter, and maintain contact with the social workers .....With thanks and best wishes"

"Framework." The word of both slavery and safety at the same time! SO, It looks like we have to wait, and that we only get to see Ellie once a week for now, and the process of assessment could take 12 weeks. 'A FULL FAMILY & FRIENDS assessment. When I was assessed by the Royal Navy for 'Nuclear Top Secret' clearance to serve on Polaris submarines, it did not take the men in black 12 weeks to go deep. It begs the question of how deep they shall go. I will keep you informed.

Meanwhile, Bridget see the solicitor at 10:00am tomorrow on the 10th. it seems I am able to SKYPE in at the same time from Boston so as to be with her on the initial consultation. So that's good.

Yesterday I spoke with a woman who had been through similar proceedings who advised me we would go for A 'Legal Guardian Order, ' a this would give us majority but joint parental rights, thus leaving the door open for parents re-entry once they get their act together....hmmm. Let's see what the solicitor says.

Meanwhile, just got an email in to say

"...The social work team can meet with your wife in the first instance on 14th November. Are you planning to come to the UK also? We can make arrangements to see you when you are here if possible. As part of the viability assessment we will need to do checks with other agencies including health, police etc, so if you are able to provide your consent we could start this process in the meantime. Can you confirm details of your travel plans with ------ please so they can arrange an assessment appointment with you when you are available.-----With best wishes...etc."

Which, praise God, all seems so very positive thus far.

Despite being a celt......I am currently encouraged!

So, my wife Bridget (seen here holding Ellie when she was but a baby!) left Scotland at 5:00am this morning and is almost in Brighton on the South Coast of England. She cannot get to see the Social Workers until NEXT THURSDAY 16TH of November. Frankly, I am shocked at this, especially as they know she has Urgently flown from the USA to attend to matters.

I am currently in Boston MA. Even so, I have manged to reach out and make an appointment for Bridget to see a solicitor in the neighboring town of Eastbourne for 10:00am on Friday Morning the 10th of November. I am assured that some intervention can take place on the same day to halt proceedings whilst we get assessed for the care of Ellie.

The firm seems to be up to date with technology and I am arranging to dial in via Skype so as to join Bridget in the initial consultation.

Interestingly, we have sent to gifts to our grandchild via the Social Workers, together with photos of us for her to see, These have NOT been passed on as yet, so as not to discomfort her? Also, we have been asked to provide info ref getting a passport for Ellie so the current Foster Parents can take her away on holiday abroad. We have complied, to stop our grandchild being placed with yet another Foster Carer whilst that happens. Even so, we want our grandchild to receive our gifts, and in some little way, so as not to forget us! We are certainly not forgetting her.
