It's been both busy and quiet on the SFCA subpoena/SB 276 front during the last week or so.

Last Friday, we held a rally starting at the San Francisco Chronicle Building and ending on the steps of City Hall. We appreciate all the support we received from Dr. Stoller's patients and the vaccine aware community in general.

The quiet part is so far, no response yet from the City Attorney's Office. I had been expecting a separate action against Dr. Stoller, but that hasn't happened, yet. I would like to think that based on our complaint, he realizes that he was provided with misinformation about the medical vaccine exemption issue. If he were smart, he'd just quietly withdraw the subpoena and let this battle play out in the Legislature and the Medical Board, which needs to figure-out how to treat physicians who wrote broad-based medical exemptions based on the language of SB 277, and the explicit statement by Senators Pan, Allen and others. But I'm probably being overly optimistic, so I'm still expecting a strong response from the City Attorney's Office soon.

The end of this week has been eventful for the community.

Yesterday, the San Jose Mercury outed the physicians who have written the bulk of the medical vaccine exemptions in the Bay area. Here is the link to the article. https://www.mercurynews.com/2019/06/20/these-anti-vaccine-doctors-are-signing-a-ton-of-bay-area-medical-exemptions/ Through her disquieting dilligence, and to the alarm of the families with exemptions, the reporter actually obtained the medical exemptions filed with the Bay area schools. Many of you ask how can this can be? During my interview, the reporter told me that she obtained the deidentified exemption letters via a FOIA (Freedom of Information Act request). I was surprised to hear that. The names of the physicians who wrote the exemptions are not protected apparently. How convenient. I am hoping that is the end of it, and that neither the paper nor anyone else will try to exploit or attempt to reidentify these records. That would be an escalation, and would have to be addressed.

Yesterday was also Assembly Health Committee hearing day. As expected, SB 276 passed out of committee. It now goes to the Appropriations Committee, where it will receive a perfunctory review and will be passed. The Chair of that Committee is the bill's co-sponsor. It then goes to the full Assembly for a vote.

The Assembly passed bill then goes back to the Senate, as it has been nominally dramatically revised since it passed the Senate. There is also word that the bill will continue to be revised, by the sponsors, and others. Don't expect anything palliative for the vaccine aware. Senator Pan has been disheartenly effective in creating the illusion of compromise where the result is no substantive change whatsoever. Nonetheless, bill amendments by sympathetic legislators is the best path to make the bill palatable (if there is such a thing), or kill it.

One child sacrificed is enough, is the way I look at it. If we can get sponsorship, look for a major press conference with one or more surprise guests, which should attract the full media. I promise it will be the event, yesterday's hearing was not. So, if you know any legislators, see if you can have them get behind a humanitarian exemption.

What Happens to Your Child’s Medical Exemption if SB 276 Becomes Law?

Finally, many families of Dr. Stoller and other physicians' medical vaccine exemption patients have asked what happens to their exemptions if SB 276 becomes law. I’ve addressed this before on prior versions of the bill. The amendments change nothing.

The purpose of the bill is to stop physicians from writing medical vaccine exemptions beyond CDC contraindications, AND to force full vaccination on all the children who have these broad exemptions, in order for them to continue to attend school. Under all versions of the bill, current medical exemptions have to be submitted to the department of public health. Under all versions, the department has the authority to review any exemption previously granted and revoke it in its absolute discretion. The current version makes noises about there being no obligation to review exemptions, and uses “family history” words, just like those words were used in SB 277.

But, again, the purpose of the bill is to get all children fully vaccinated who don’t meet the CDC guidelines. So, for planning purposes, if SB 276 becomes law, you are going to need a plan B, as early as the beginning of 2021, when the bill is currently scheduled to take effect, if it becomes law. Sorry, but that is the cold, hard reality of it. So continue with all your efforts.

Dr. Kenneth Stoller Files Lawsuit Against the San Francisco City Attorney’s Subpoena for his Patients’ Medical Records and Genetic Information

Today, Dr. Kenneth Stoller has filed a lawsuit to stop the San Francisco City Attorney’s attempt to obtain the medical records and genetic information of his vaccine exemption patients. The basis of the City Attorney’s subpoena, which was served and widely reported in the media on May 8th, is a purported public nuisance investigation about Dr. Stoller’s practice of writing medical exemptions for children who do not meet the strict CDC (Centers for Disease Control) vaccine contraindications.

We believe that there is no real investigation. Rather, the City Attorney’s press conference announcing the subpoena was intended to create public support for SB 276, which would remove medical vaccine exemption decision making from physicians and place it in the hands of state or local public health officials. Under this bill, an important medical decision will be made by state or local government employees who have never met or spoken to the patient or family.

SB 276 was introduced and is being promoted by Senator Richard Pan who has created the false public relations narrative that SB 276 is necessary to stop a few physicians from writing what he considers to be fake or fraudulent medical exemptions. In reality, some physicians like Dr. Stoller are issuing medical exemptions based on the clear and explicit statements made by Senator Pan and others, that medical exemptions could be written based on considerations much broader than the narrow CDC contraindication guidelines that he now seeks to impose on all Californians via SB 276.

Many of the medical exemptions written by Dr. Stoller (and other like-minded physicians) are for siblings of vaccine injured children. These exemptions are valid medical exemptions written to protect the families’ other children from potential adverse reactions, they are neither fake nor fraudulent.

In addition to seeking to quash the City Attorney’s subpoena, this lawsuit seeks to prove that if there is a public nuisance, the vector or cause is not the medically vaccine exempt children, as the public is being led to believe. This lawsuit also seeks to establish the legal rights of the families of vaccine injured children to obtain an exemption based on considerations beyond CDC guidelines as a right to receive medical care and advice different from the conventional medical majority view.

First, as a result of the City Attorney’s Press Release, the Administrative Subpoena, and all the media frenzy, Dr. Stoller no longer has an office at the San Francisco clinic where he worked up until the City Attorney's action. He has relocated his office closer to his home, outside of San Francisco County.

Second, we submitted extensive objections to the subpoena. Since that time, there have been further communications between us and them.

You should know that providing medical records in any form is NOT an option under discussion.

Early next week, the subpoena will either be withdrawn and this matter will end, or there will be litigation on the subpoena, AND what we think is behind it, and various other matters which will be of keen interest to the vaccine concerned and families of the vaccine injured. You will see "SB 276," many, many times in the papers.

Third, all donations from the terminated GoFundMe campaign were transferred to the Dr. Stoller’s legal defense trust fund.

And finally, Dr. Stoller and I, and our team (and there is now a team) would like to thank you all for your support. This investigation is precedent setting, albeit in a bad way. If the San Francisco City Attorney gets away with it here, I would expect other cities who have physicians writing medical exemptions beyond CDC guidelines, to start tossing out subpoenas on pretextual, non-existent public nuisance investigations. We are very much aware of this and of our responsibility to the community. We have your back. Thank you for having ours.

I spent a very long and intense week analyzing, researching and putting together a response to the City Attorney's subpoena for Dr. Ken Stoller's medical records. I submitted what I called an initial response yesterday afternoon. It was 20 pages with many, many citations to a wide variety of literature sources, and raises many of the legitimate concerns and suspicions of the community. Even though we had another week to respond, I wanted to get the ball rolling quickly, once I figured out what was going on and realized how misguided the City Attorney's efforts were.

If the investigation isn't resolved, I'll release the response. My hope is that the City Attorney rethinks his position and withdraws the subpoena, and we both live to fight another day. (But I may be overly optimistic.) My reasoning is that the response will create a media firestorm. (I know this because the media is already chomping- at-the-bit for more information). I don't want the media to back these guys into a corner, (not yet anyway). If we see that a court case in inevitable, you'll see it, and more. You'll like it,
