Hello everyone,

I am an Iranian student of Information Technology in Vienna and I use to successfully work as a programmer until my request for a student visa extension was rejected by Austrian officials (MA35) via a vague letter which suggested that they do not BELIEVE that I am a student anymore although I have/applied 4 different documents which proves otherwise.

Of course with loss of my visa, my work permits in Austria went down the drains and since then I have been paying all expenses from my savings for about 10 months now.

Finally last month I was invited to the court due to a complaint letter I organized through a law firm and I managed the payment of the complaint letter and the hearing at court via my savings.

However, the court has decided for a second hearing before issuing a sentence, which is most likely a positive answer since they have asked for a couple of documents which normally are asked if a visa extension is about to be issued.

Before all of these, I was a successful programmer/student and I was planning to travel back to Iran after my visa extension to visit my grand parents whom are (101 and 91) years old and one of them already have had their second heart stroke.

My lawyers believe that I am being punished because I decided to take a semester off from university regardless of the law that allows me to do so in special cases such as my grand parents health situation. (of course documents to prove my grand parents health state has been presented)

Fun fact at the first hearing at the court, judge didn't even mention the main reason that my original application was rejected even once as I am clearly a student and a successful one at that.

Due to sanctions I cant even ask for help from my family in Iran and my own resources have been depleted.

To prove that this is nothing but a true story I am willing to provide documents for whomever interested and I am willing to payback whoever is kind enough to help with my situation after my situation is resolved in due time, As soon as I get my visa and work permit back I can get back to the company I use to work for, they are waiting for me.

Please note that, my life is on the brink to be ruined by the mistakes of others (gov. officials) and when I consulted my lawyers for making a claim for damage, they have strongly suggested otherwise because suing a legal foundation which is not only directly linked to the government but also is a part of a government is a fight I cannot win and requires a lot of resources (money, contacts) which clearly as a foreign student with limited work permission (only 20 hours a week) I do not have.

However, both lawyers I have spoken with have strongly advised against it. they said it is one thing to make a complaint for the decision of visa extension rejection and completely another to pick up a lawsuit against the mistake they have made itself. To pursue with a lawsuit to
