Kelly Sutton's hearing on her writing eight medical vaccine exemptions starts this Monday, June 14th. I hope to post information by Friday about how you can watch or listen to it.

We just received the judge's ruling on the Board's Motion to limit the evidence, two parts of which was it's attempt to know out James Lyons Weiler and Mahin Khatami from the case. The judge knocked them both out of the case. I am not sure what the reason was. It could be that they are both PhDs and not medical doctors and the judge indicated that their testimony was duplicative or only marginally different from the other witnesses. That seems wrong to me, but she's the judge and I am just an attorney for a party.

I will post both of their expert reports and the judge's order on my website blog. www.rickaffe.com. The expert reports reading, the judge's order, not so much. You'll be aggravated by the brevity of the reason and the stinginess of time given the stakes for Dr. Sutton, but welcome to the world of administrative or pretty much any law proceeding involving challenging the infectious disease paradigm.

Under SB 277, a physician is permitted to issue a medical exemption if she determines that immunization “is not considered safe” for the patient. I confess to perhaps naively thinking that we could defend the Board’s case against Dr. Sutton by showing why she did not consider immunization safe in the 8 patients involved in the Medical Board’s accusation against her. To that end, we are offering a great deal of evidence in the form of an expert report from Jac Weiler on the problems (many of them) with the vaccine studies. I shared his report previously on my web page post accompanying this update. We also received an expert report from a world class PhD immunologist who reviewed the immunological issues facing each of the 8 patients.

As I predicted in a prior update, the Board is moving to strike Jack Weiler and our PhD immunologist (Mahin Khatami) from testifying and broadly argues that vaccine safety is not an issue in the case since it is already proven in the ACIP Guidelines, and this case should not be a public referendum on vaccine safety.

The board is literally arguing that vaccine safety evidence and data is irrelevant to any legitimate issue in the case.

Really!

The board’s view is that the only issue in the case is whether the medical exemptions issued by Kelly complied with ACIP Guidelines. If they didn’t, then the Board claims the case is over because actual evidence of vaccine safety should not even be admissible since it is not relevant, even though SB 277 specifically states that a physician’s decision for exemption should be based on a determination of immunization safety for the patient. That’s really what the board is saying!

In addition, the Board is trying to stop the parents of the two families we have listed as witnesses from testifying about their current condition, which is much much better now that they are unvaccinated. Apparently, thriving kids and kids on the mend from prior vaccine injury is not relevant, according the Board, in this case.

I would expect that there will be a hearing on the Board's motion later this week.

The hearing begins on Monday, June 14, 2021, and will last between 4 and 6 days, depending on what the judge decides on the motion in limine.

Kelly Sutton's administrative hearing is set to begin on Monday, June 14th, and should last most of that week. It will be watchable (or at least listenable) via zoom or teams. I l will post details closer to the hearing date.

The board is calling one Expert Dr. Lehman who is a UCLA pediatric infectious disease expert. She is the expert in a number of the cases I am working on for ME writing docs. Her view, not unexpectedly, is that it is an extreme departure from the standard of care to have written all of these ME's because none of them are based on the contraindications or precautions to any vaccine as set forth in the ACIP guidelines (similar to the AAP's Red Book guidelines). Like all the other cases, she also faults Kelly for writing the ME's without having in her hands the prior medical records to verify, what exactly I am not sure, since nothing in the records would have justified the ME's in Dr. Lehman's view.

This case is somewhat different from the Stoller or Kennedy cases because here we have a number of kids who were not thriving and had ongoing issues, most likely relating to prior vaccination. To that end, we will have testify a well-credentialed academic pediatric neurologist, as well as a physician who works with developmentally challenged children. We will also have a very feisty pediatrician who has some choice words for Dr. Lehman's lack of knowledge in some key issues with the children in this case. That should be fun to listen to.

We are also bringing a world-class former government immunologist who is going to explain to Dr. Lehman and the judge some of the immunological issues which is beyond Dr. Lehman's pay grade.

Finally, an all-around expert on the problems with the current vaccine paradigm, Dr. Jack Weiler has prepared a terrific expert report and is planning on testifying. I say planning because his report is so good and so cuts down the established world view, that the Board will surely try to stop him from testifying. We will know by the 26th if that is the case. The judges in these types of cases try to keep the focus very, very narrow, so I am making no guarantees that he will actually testify, but one way or the other, there will be an extensive discussion with the judge about him and his report. That much I can guaranty.

I am grateful for MD's and other healthcare providers who stand up for informed consent and the freedom to make health choices for our families before any interventions into our bodies and bloodstreams. While we see immediate negative effects in some, for most of us suffering chronic dieases, when we trace back the red flags often we see that, a vaccine was the final straw in our chemicalized world which took us down some steps from our formerly robust lives.
