Justice is not hearing me out

I had a bike accident last year with a car coming from my right side (legally my fault) and had stupidly no insurance at that time.

All I remember at the time of the accident, is thinking that the car was going way too fast (had no way to prove that though), and that I was grateful that I was alive.

After looking at the scratches on his car, the driver and me made a verbal agreement: he will repair his car and send me a bill that I will pay from my pocket since I didn’t have any liability insurance at the time. I tried to be as honest as possible and told him straight away that I didn’t have any insurance and that I would definitively cover the costs myself, that he had absolutely no worries to have about this and he could trust me. I gave him every information he needed to be able to send me the bill directly. We were both grateful nothing more serious had happened, we apologized to each other, shook hands and left respectively happy about the agreement we had just made.

2 months later I received a letter from his lawyer, asking me to pay 3000 € without any bill nor any cost calculation. Confused and surprised, I then went to his Spätkauf to have more information. He wasn’t there that day and so I spoke with his son who told me that if I wanted to see a bill I had to pay 4000 € first. This seemed pretty strange to me, it felt like he was trying to make money out of the situation. It also seemed odd that I should pay 1000 € to see a not yet existing bill. Not only didn’t he respect our first verbal agreement, but he engaged things to another level by involving a lawyer.

Scared and unable to defend myself alone, I ended up hiring my own lawyer. The last year has been about ongoing letters back and forth, before we ended up in court, because he put a complain against me, because he wants more money than I can offer.

The damages on his car are worth maximum around 1000 €, and this is what I have been trying to offer this whole time, but he is being super greedy, and wants to make money on me.

I am still wondering why it was necessary for him to get a lawyer in the first place, asking for such a big amount when I was always willing to cooperate and be as honest as possible to find an agreement we both would be happy about ? Why would I have to pay 1000 € to see a bill that I want to pay ?

I never tried to deny my responsibility, from the start I was ready to pay the damages I caused, I just wanted to pay what it actually costs. He had all the necessary information in order to reach me and discuss further about the incident and I was always cooperative.

He hasn't repair his car, and also did some kind of fishy expertise where he unjustifiably asks for over 3000 €, the majority of the costs are in no way part of the damages I am responsible for. This shows again clearly his attempt to make money over the situation.

There is also no proof that his car wasn't already repaired, paid by his own insurance, or, in case it was his function vehicle, that it wasn't taken in charge by his work.

Unfortunately, being not german, I am really not so aware of all my rights, and it has been super difficult to defend myself, the judge is simply not hearing my out. Being a student, I have absolutely no money to pay this whatsoever. I am already struggling paying my rent and buying my food every month.

I already had to pay almost 1000 € of lawyer fee for my defence, and now the judge has given him all the rights. I lost the entire case. Nothing is given to me even though the judge had said that she will take a decision which would be ok for both sides. I received their reply yesterday, I have to pay 3.348,79 € which is the amount that is taken from this fictive estimation provided, as well as his lawyer fees which are 823 €.

I tried showing the judge that he is trying to make money, I tried showing the judge I don't have that money, I tried and tried but no one is hearing me out, as if I was a criminal and this was my entire responsibility, no one sees that he is trying to scam me, and this so unfair. I don't have this money :( My parents don't have anything either, I never had money in my family, and I already struggle with my monthly expenses.

I feel lost, and also disadvantaged because it isn't my country, it isn't my language, and I never learned how to defend myself against such a horrible person.

If he had respected our first agreement, his bill would have probably cost around 1000€, exactly the amount of money that I gave to my own lawyer. It is such a stupid thing, stupid process, stupid everything.

This is why I thought why not try this, because I have no other ideas of how to seek help otherwise.

I hope this story will soon be put behind, so I can concentrate on my studies and on my art, things I love the most, and which have more importance than this kind of unhealthy behaviours from unhappy beings that unfortunately exist also on this planet.
