Wednesday 13th November, my company sent me Termination Notice with Immediate Effect and I need help to fight them at arbitration (one of the clauses of the contract), which they choose, as the costs would perturb most people. CROWD FUNDING CAN HELP me slap them down.
The company tried to force NEW CLAUSES into the CONTRACT without negotiating and without written notice. One of my criteria for joining the company in the first place was if these conditions were not part of the contract, which they obliged and they were not in the contract at all.
On October 24th the Director insisted that I adhere to the clauses that he said were ALREADY in my contract - when I pointed out later that they WERE NOT - SILENCE from him!!
On Monday 11th November around 3:30pm I was called into the office and told that my contract was being terminated and a new one would replace it with immediate effect upon my agreeing it - which they knew I wouldn't agree to, if it contained the new clauses, so at that point it was looking like a straight forward constructive dismissal case.
On Tuesday 12th November, after I had questioned the termination reason, I was ordered to be in the office at 8:30 next morning despite my email to them stating that all communications going forward, relating to contract changes should to be by email. I didn't go to the office (I don't like to be treated like I am a dog, who will come, sit, stay at owners whim).
Wednesday 13th morning I get ANOTHER Termination Notice with IMMEDIATE EFFECT stating it was due to "continuously refusing to comply with management directions/instructions". I have asked for their evidence and any warnings they gave me (if it was continuous, surely there would be lots of evidence and clear warnings given??) - of course there are none and they are unwilling (or unable) to send anything to me personally and only via a lawyer!! The contract only states 4 reasons for immediate termination and the reason given is not one of them, but they have said they will continue with the course of action as it is, thereby breaching their own contract. There are other breaches that will have other consequences but that is not relevant to my own case.
I have already seen a lawyer to go through the contract in detail and there is a very strong case in my favour. The contract (by the Director's own admission is "cobbled together and never been seen by a lawyer)" has so many errors, omissions etc.
But ARBITRATION IS SO EXPENSIVE and each party has to pay own costs.
SO PLEASE, PLEASE, PLEASE, HELP THE SMALL GUY TAKE ON THE COMPANY and have DUE JUSTICE. They are clearly assuming I will just go away as I can't afford the legal expenses on my own. WITH YOUR WONDERFUL CROWD FUNDING HELP I CAN FIGHT THEM ALL THE WAY !!
Even before sending me the Termination Notice they had been into my work email account and deleted all emails, folders etc !!
I gave them ample opportunity to revert back to how things were before they insisted that the contract contained clauses it didn't, and mentioned the can of worms they could potentially be opening (local regulator, immigration department) if they continue . So on their heads be it. They have more to lose than me.
