My mother is and has always been a devout Catholic. She had always helped others, but now she needs help herself.

My 74 year old mother has been in the NYC Adult Protective Services (APS) for only a few years - An agency in place to protect her. They have failed her in this regard, and sadly, she is facing severe hardship as a result. She was placed in this system after my family had moved away, and mom didn't want to come with us for the sake of her best friend (passed away this year) and her church. St. Rose of Lima in Queens on Beach 84th Street.

A court appointed gaurdian (from a private organization) was assigned to to her less than one year ago... It was his responsibility to ensure she was protected. He has lied and failed her. My mother has literally lost everything including some near and dear family posessions of which were handed down from my Grandmother. He has taken all of the funds in her bank account out (closing it out) and she is not receiving any social security benefits directly to her either... This was changed by the gaurdian 2 months ago.

This (bank closing) was done while my mother was hospitalized -July 21st thru August 10th. My mother said he was shocked when she told him her son was comig to get her out, and became arguementive with her because she never told him about me. In my opinion, he was working on some sort of sacm, and now faces being exposed. The pratice as I see it is to take control of elderly people, secure all of their assets, send them away to long term nursing, and wait for them to die. The gaurdian is left with the task of notifying next of kin. My mother almost fell trap to this situation... She lives alone, and keeps to herself. My mother claims to only have met him once prior to her becoming ill, and was surprized that he was upset... His claim to me was that he didnt think I existed -and he laughed about this. I faxed him a copy of my birth certificate at his request for proof. He was in communication with me almost daily until I asked for my mothers posessions... Then he stopped answering all calls. I am at a loss of options now.

The Gaurdian under his court order has the legal right to control her money and assets. He by his own admission has all of her required paperwork and has secured some money... However he recanted this the last time I spoke to him after he failed to send her items to my house via FEDEX as he promised.

The Adult Protective Services office has advised me that the Gaurdian is in receipt of my mothers Social Security check (allowable by court order), and if he has not surrendered either them, nor her property (also specified by court order) at request, I will need to seek legal advise. Based on my discussion with him early on, he has either disposed of her items, or neglected to take proper care of their safe keeping. He entered her apartment (as explained to me by the landlord- showing his authority to do so to him), removed all of my mothers furniture and other items via a helper he apparently employed. The gaurdian then turned over the apartment (yeys) to the landlord while my mother was in the hospital stating on a document that I have, that she will not be returning anymore on account her mental condition, and she cannot help herself. He has a document stating my mother is mentally incapable of making her own decisions. Watch the video and you determine that if you feel this is the case.

The apparent intent was to have her placed in a nursing home until she dies. I found out she was being sent to Pennisula Senior Care, and stopped this from happening. My mother is staying with me now.

I have spoken to legal council, and need to secure funding to enable me to take action for my mother. That amount is $3500 for retainer.

I am also trying to raise funds to help my mother get back on her feet with clothing and basic needs. This is why I have placed this campaign.

It has been over 30 plus days and no return call, nor any formal response from anyone in the Gaurdian agency.
