New York Court Grants TRO for NYPD, Halting Vaccine

On December 8, 2021, Judge Frank Nervo, Manhattan Supreme Court, signed an Order to Show Cause in the NYPD vax mandate case (see link below). The Court scheduled oral argument for yesterday afternoon on an application for a Temporary Restraining Order (TRO), seeking to enjoin the Mayor's Mandate. Patricia Finn, Esq., representing Plaintiff, gave a powerful argument, on behalf of an NYPD Detective, and all others similarly situated, explaining why the vaccines mandates violate the law, and should be struck down.

Yesterday afternoon, at the conclusion of Oral argument, Judge Nervo from the Bench, granted the TRO restraining the Mayor of New York City on the vax mandate pending a hearing.

In response to the TRO, outside the Courtroom, the lawyers for NYC's Law Department gave statements to reporters, apparently confused about what had just happened. It was reported the City's lawyers stated: "Unlike every other Court that has considered the [vax mandate] question, a single Judge has appeared to have issued a TRO prohibiting the City from putting a single police officer who refused to be vaccinated on leave without pay." That's only half right!

This was a surprise to Attorney Finn because during the hearing when the Mayor's lawyers, specifically, asked the Court to clarify the ruling, and if the TRO applies to all others municipal employees, Judge Nervo responded the caption of the case says "all others similarly situated," and declined further comment.


The simple fact is in NY, adult vaccine mandates are prohibited by State and Federal Laws, and the Mayor has no power.
