Biju and his wife (from Kerala) were working in a newly-opened private school in Panipat, Haryana in 2016. Biju was working as an administrative officer while his wife was the principal of the school. The husband and wife, along with their 6-year-old son, had moved from another private school in Jhajjar in search of a better future. Never in their wildest dream did they realise that this career move was the worst mistake of their lives and would damage their reputation and happiness forever.
The school was being run by a trust created by one of the biggest exporters of India and needless to say a set of very powerful people in Panipat and Haryana. The management had acquired land from villagers to construct the school. The issues with the acquisition of the land lingered on between the locals and the school management. The locals demanded more fee concession for their children who studied at the school which the school management refused. The villagers started creating problems for the school. The head of the school management used Biju's wife, who was the principal as a pawn to file personal complaints to police and local administration against certain locals. The complaints were for bad behaviour and personal threats etc. The school management never filed a complaint against the locals on behalf of the school itself.
The agitated local residents threatened the principal and other teachers. She was also getting pressurised by the head of the school management to file cases of molestation against locals. When she understood that the school management is using her shoulder to fire at the locals, she refused. This infuriated the school management to no end. Fearing for their and their small son's life, Biju and his family, ran away one night in without giving a formal resignation. They took this extreme step, in spite of not getting paid for the previous month's salaries. This infuriated the school management further. They misguided the locals into filing false affidavits saying that Biju took their childrens' school fee without providing any receipts. The school complained to the police that Biju and his wife misappropriated funds. The police in their investigation found the complaint to be false and didn’t file a case. The police closed the complaint on at least 2 occasions. As part of this investigation, they called Biju multiple times to Panipat police station and he gave them the truth point-by-point. When the head of the school management saw that the police is just not heeding to their wish, they used their power and influence to get an FIR filed through the local court. The investigating officer (who changed multiple times) didn’t find any truth in the charges. The school then approached the court for a status update. Under pressure to act, the police called Biju to the police station on some pretext and kept him in confinement. They reached out to the family and demanded a bribe of 2 lakhs in lieu of not arresting him.
The God-fearing, law-abiding family is from a typical middle-class background and were earning just as much to keep themselves afloat every month. When they couldn’t arrange for the bribe, the police arrested Biju. Lack of understanding of the judicial process and lack of finances to arrange for a good lawyer hit Biju heavily. Eventually, one of Biju’s friend in Panipat arranged a lawyer known-to-him to take up his case. He was tortured and threatened in police custody, more demands of money were made to his family. He was told that his wife will also be arrested. Fearing that she will be tortured and harassed like her husband, and clueless on how to deal with all that was happening, his wife fled to Kerala along with their son. The police took him to his in-law’s house in Delhi, where the old couple was harassed and asked for a bribe to get their son-in-law released. In the meantime, bail was denied to him and he was sent to judicial custody. Every day in imprisonment is a harrowing time for Biju. It’s been more than 50 days now since all this ordeal started.
