Hello everyone my name is Nan. I live in Mesa, Arizona. I have been a probation officer since 2005 for the Superior Court. I have been in law enforcement since I was 19 years old. I have had an awesome career and have helped hundreds of people beat addiction, fight for their rights, and help win their cases. I believe empowering people when things seem all is lost and the odds were stacked against them. I still believed in them when no one else would. To this day, I see people I have helped in the community and they have nothing but good things to say how I helped changed their lives for the better. You see when I was 19 I worked in a maximum security prison and have seen what hopelessness looks like. I vowed to help people before they received life sentences either incarcerated or with drug addictions. I had a pretty great track record until this happened incident to me.
On August 2013, I had to have a knee replacement. I was given a full release to return to duty on January 6, 2014. The probation department refused to accept my doctor’s note requiring additional paperwork they wanted to be filled out. The department extended my leave until I return to the doctor to fill out their paperwork. (The paperwork was a list of duties and if there were any restrictions for my return, even though the department stated they did not accept any restrictions and did not have light duty available) Confused yet? Yeah, me too! I had a full release to return to duty with zero restrictions back on January 6th. The probation department was starting to play games. When I reported to my doctor I had a developed bursitis in my hip and he didn't want me returning to the field immediately until the flare up was under control and stated I could return to work with light duty so I could attend rehab. When I took that paperwork back to the probation department they stated they did NOT have light duty. What? Really? So, I asked to use my sick time to cover my leave. No answer from them. I asked what they called the many times I covered the caseloads of pregnant or terminally ill officers. No answer. They stated if I did not return in 3 days they would consider it job abandonment. However, my doctor did not want to release me for liability reasons in case I was hurt in the field. I returned to work that 3rd day and worked 2 hours and the probation department came in and told me they were releasing from duty due to job abandonment. I stated I was NOT abandoning my job I was there to work. However, they still basically fired me but they had to take the job abandonment route because if I was fired I had the right to appeal through the department.
I took my case to the EEOC. After a review from Washington they stated they agreed that there was a violation and proceeded giving me a determination letter to sue the probation department. The federal government cannot represent a state employee against a state agency. Yes, I have learned along the way that state employees have less rights then regular folks.
I have hired a couple of attorneys and I can write a book on what to look for when looking for someone to represent you with your case so you will limit getting screwed out of money with zero results. My case was filed in Federal Court where I thought I would finally get my day in court with a jury. I am positive that once my story was told and when the evidence was presented I would win my case hands down. I have learned that a judgment summary is a short cut to try and get your case dismissed. You see Federal Courts look out for lower courts and that is who I filed against State of Arizona Superior Court.
I am at a crossroad now. Modern day David and Goliath. Goliath has unlimited resources and I do not. I need an appellate attorney and they state they will only take my case with a $50,000 retainer. Which I think is utterly crazy. However, I know a person that represents themselves has a fool for an attorney. This is why I am turning for help. I have until May 17, 2019 to file for an appeal against the probation department. If I am granted an appeal from the 9th district then my case will go to jury trial which is what I want to have my day in court in front of my peers. I have spent my life helping others and this is the first time I have to ask for help. This is why I am here. I am asking for financial help to obtain legal counsel to get my job back. I was set to retire in November 2018 with my 20 years in with the department which is what I was working for since I was 19 years old.
The money is going directly to the attorney for my appeal and get my case back in Federal Court to be heard. I am asking for your help. A stranger helping someone in need that they do not know is a miracle. I have used every dime I have to fight this and it is not enough and I cannot let Goliath win. Goliath has won the battle for now, but I will win the WAR. I need your help to do it. I am asking you to donate anything if you can and if you would share my story. Since this has happened to me I have had other officers reach out and ask for help since the same thing has happened to them. I have done everything I can to help them. Cancer/illness/surgeries should not be a reason to lose your livelihood. I have helped these people navigate what to do so they can understand and handle their case more efficiently and not to waste money what I learned the hard way.
