Concordio spent all of his retirement pay to build a Store (Property B) beside his House (Property A). When his daughter could not pay a lending agreement involving only the Store, lenders changed the words of the original lending agreement to include Concordio’s House without the knowledge of the true and legal House owners. Then the greedy lenders seized their declared “property” of Store "and House".

This is the systematic way they are grabbing Concordio’s House:

  1. Include adjacent House Property A as part of seizure order
  2. Encroach into House
  3. Force needy and powerless occupants to leave House
  4. "Sell" Store and occupied House areas
  5. "Buyer" intrudes deeper into House
  6. Store and House "Owner" sells Property ...

Encroach into House

During the seizure of the Store in 2011 for non-payment of about IM php, the lender seizing the Store made an arrangement with the innocent children of Jolyna. As a result of having no legal counsel, Concordio had to move from the comfort of his master bedroom to the coldest room. With no funds for filing a legal complaint (in 2011, Reynaldo lost all his property to the worst flooding of "Ondoy") moreso pay the fees of a court case, Concordio is enduring the encroachment into his House. He could not put up the obvious defense that his 120sq.m. House is impossible to be added to the 66sq.m. lot of Property B which includes Store area.

Force needy and powerless occupants to leave House

From 2011 to 2018, the Store owners prolonged their encroachment into the House. They systematically avoided a legal joint survey that will clearly define Store and House boundaries then blamed the House owners for the delay. For several years, they made life miserable for the House occupants to give up their property. They jacked up the House power consumption by doing welding in the Store. When this was complained, they put up a dummy electric panel in front of the Store. There was an electric meter inside but just for show because closer investigation revealed that their electricity was still connected to the House power supply. When a barangay complaint was filed, they finally separated the Store power supply but illegally cut the House power supply. They also cut the House water supply. For a long time and to this day, Concordio is not able to get a decent bath in his House. They filled the first half of the garage with junk to make it difficult for Concordio and Josephine to freely go in and out of their House. Relatives and friends were inconvenienced to visit. By blocking the only entrance, repairs are doubly difficult and the House is deteriorated badly.


“Sell” Store and occupied House areas

Recently, the Store owners declared themselves to be the seller of the “property”. After publishing the sale in Facebook, they announced to the neighborhood that the “property” had been sold. The Bgy .Captain informed the House occupants that the Store owner had already endorsed the “property” to the buyer and now new owner of the Store.
Upon hearing this, Concordio’s son Reynaldo rushed to put boundary signs for the House he co-owned. Upon seeing the Not For Sale signs, most people in the neighborhood were surprised to realize the limited extent because the Store owners declared openly that they owned the House areas they occupied.


Barangay meeting

A Barangay meeting was held on February 19, 2018. It was agreed that a joint survey should be first made to establish legal boundaries between the Store that was “sold” and the House of Concordio (co-owned by son Reynaldo and daughter Jacqueline). It is within knowledge that when NO Absolute Deed of Sale or any other document proving the transfer of property could be presented then there is no legal sale. Informed about this, the Bgy. Captain vouched for the “sale” because the alleged seller was already present in the meeting. For the first time ever (click to see video), Reynaldo met and talked with the alleged seller of “property” that included the encroached areas of the House he owned.
The alleged buyer and new owner of the Store, informed the group that she had already arranged for movers to transfer her belongings to her new “property”. Reynaldo was assigned to write an agreement allowing House areas to be occupied. The Bgy. Captain asked the new Store owner if she was willing to move her things out of non-owned areas once joint survey results clearly define property boundaries. To which the new Store owner agreed.
Forced to give up House areas in favor of the new Store owner, Reynaldo was distressed because he had also scheduled to move his belongings from Manila to Baguio within the week. After the meeting and upon leaving the barangay hall, Reynaldo suffered extremely high blood pressure and was taken by sister Josephine to the SLU Hospital Emergency where he was admitted. When he was discharged long past lunch on the same day, he experienced blurred vision and was not able to execute any agreement with the new Store owner. Reynaldo immediately left Baguio because his medicines were in Manila.


"Buyer" intrudes deeper into House

While Reynaldo sought treatment in Manila, the alleged seller gave the keys of the master bedroom to the alleged buyer. Without legal proof of sale (Absolute Deed of Sale), without the joint survey to clearly define property boundaries, without permission from the House owners, without an agreement to occupy House areas – the new Store “owner” occupied the House. The master bedroom is clearly not covered under the TCT measurements of the Store. But based on the declaration of the alleged seller that the master bedroom is part of the “property” sold, the alleged buyer filled Concordio’s master bedroom with her belongings starting February 20, 2018. The previous Store owners only half-filled the garage with junk. The new Store owner now filled the entire garage with belongings.


Serious Illegal Detention of Concordio inside his own House

On the morning of February 21, 2018, the new Store owner loosely placed a heavy chain across the whole gate. It is possible for Josephine to squeeze herself through, but with the chains it is impossible for Concordio to exit or enter his own House. It seems that what was previously done by alleged seller to the House occupants is now more deliberate and merciless. With the constant complaints of Josephine to the police, the police came and filed an unjust vexation (illegal closure of main gate for entrance and exit) against "seller and buyer" of the "property". On February 28, 2018, the "buyer of property" accused 93-year old Concordio to have stolen the heavy chains. She placed a new set of lighter chains across the gate. Hearing of this, Reynaldo sent a text message from Manila to the Baguio Police Emergency Hotline to complain about the imprisonment of Concordio inside his house. Together with the frantic calls of Josephine to the police, a police car was again dispatched to the house. The police broke the chains and commented "kasla aso da met nga kinulong (the occupants were caged like dogs)".


Preventing Entry/Exit to the House

With her plan to use chains to deter entry/exit to the house by its occupants not working, "new owner of property" welded in place a new lock for the main gate. She told Concordio and Josephine that they only have 2-3 days to use and pass through her "property". She said "Agtapwak kayo laengen (Jump from the balcony'). Alarmed by the seriousness and the pace of house grabbing, Reynaldo traveled from Manila on March 2, 2018. Upon arrival in Baguio, he could not get inside his own house because the gate was bolted. He asked permission from the laundry located inside the Store property. He learned from the laundry store occupants that the rental of the laundry was still being collected by the alleged seller of the store even after the alleged sale. Further to the conversation, the alleged "buyer" has not paid the "seller" the alleged 4.5M php selling price of the Store property.


8888 Citizen's Complaint and prompt Presidential Action Center remedy

A request for Certificate to File Action is now with the barangay. The Public Attorney's Office has advised the use of private legal services to remedy Concordio's case/s. To put things in order, there are at least 3 cases with legal costs amounting to over 199,000 php. First is to eject the grabbers from illegal occupation of the House, second is to take back illegally seized property, third is to STOP the fraudsters for good.

As I was about to pay higher grade reading glasses at the upper floor of SM North, I had a very strong urge to get reading glasses at the lower floor. While paying, it was a miracle to be next in line with Ron at the cashier. We have not met for 22 years but in that chance encounter, he not only paid for my eyeglasses but also is the first to contribute for this legal cause. Thank you Ron and Flor.

It is very true when the Lord says help will come in the soonest possible time. There is so much that needs to be done within the shortest of time. I have been continuously receiving advices from the Department of Justice Public Attorney's Office to start the cases against the. . . . .
