The latest UPDATE: On 30.3.21, we finally got a decision by the High Court of Sabah & Sarawak whereby the appeal by the Developer's lawyer was denied. Our Campaign has always been to show unscrupulous developers using lawyers to craft biased JVA, which sadly we have to litigate later (obviously you may want to avoid this by getting an impartial JVA or nothing). But even with a partial JVA, the lawyer here decided that he could get away with misrepresentation. During the trial, he misrepresented his case that a document known as a certificate of the stage of work done is another document known as a certificate of practical completion. In short, he tendered a document knowing that it is not a CPC as a CPC . The Judge accepted that it is a CPC too and that is why indirectly it also says a lot about the Judge who obviously can read English. A copy of this Judgment is found here. Unfortunately, despite the seriousness of this misrepresentation which was sanctioned by the Court, the lawyer was only ordered to pay RM2,000 in costs to me which is nothing compared to the fees I had already paid for my case against him. My lawyer has advised me that we need to follow up with the Architect who also lied about this document being a CPC and the developer lying the same by filing contempt of court proceedings against them or filing police reports against them for lying in Court.

This campaign is about breaching joint venture agreements and the consequences of a court process that started in the High Court in Sandakan and to the Federal Court (by way of review). The reason why we are here is to highlight TWO things which we are campaigning and that is 1. Local Council cannot use their power to approve projects as the means to extract land from landowners. 2. To educate landowners to be very careful doing JVC with Developers, Hence we like to raise funds to further this causes. There are more of course but this campaign is basically to find out who may be interested in this journey. The latest update. We got a decision from the High Court which proves conclusively that the lawyer representing the developer had misrepresented a document known as a certificate of the stage of work done as a Certificate of Practical Completion "CPC"). This was my case in court that there is. . . . .
